American companies have a problem. They need workers but can’t find them. Many businesses post job ads and wait for months without finding the right person.
When this happens, some companies look outside the U.S. for workers. They need to understand what is sponsorship for employment and how it works. Employment sponsorship is a way for companies to legally hire people from other countries when they can’t find Americans to do the job.
Big Numbers Show Reality
Last year, almost 60,000 American companies filed more than 563,000 applications for just one type of work visa.
Amazon hired over 7,000 foreign workers in 2024, plus Google and Microsoft each hired thousands more. But here’s the catch: for every 100 people who applied for these visas, only about 11 got them. The government only gives out 85,000 of these visas each year, but nearly 800,000 people applied.
How Companies Hire Foreign Workers
First, a company must prove they really need someone with special skills. They can’t just say, “We want to hire this person.” They must write down exactly what the job needs: what degree, what experience, what technical skills. The job must be real, not made up.
Next, they pick someone from another country who has all these skills. The company checks their college degrees, work history, and any licenses they might need. If the company wants to hire this person permanently, they also must prove they tried to hire Americans first. This means posting job ads, doing interviews, and keeping records of why American candidates didn’t work out.
Then comes the paperwork. The company sends forms to the government asking for permission to hire this foreign worker. If it’s a temporary job, they use one form. If it’s permanent, they use a different form. The government takes months to decide; sometimes six months, sometimes ten. Companies can pay extra money to get an answer in 15 days instead.
After the government approves the petition, the worker must visit the U.S. embassy back home. They’ll sit through another interview, submit more paperwork, and get their fingerprints taken. If the embassy officials like what they see, the worker gets a visa stamp on their passport. That stamp is their ticket to fly to America and start their new job.
Different Types of Work Visas
The government has different visas for different situations. Some are temporary, some are permanent.
The most popular temporary visa is called H-1B. This is for people who went to college and have specialized jobs like computer programming, engineering, or accounting. These visas last three years but can be extended to six years.
Another type is L-1, which is for people who already work for a company overseas and want to transfer to the American office. H-2B visas are for seasonal work like farming or working at ski resorts.
Permanent visas are harder to get but lead to green cards. EB-1 visas are for talented people, like famous scientists or top executives. EB-2 visas are for people with master’s degrees or special skills. EB-3 visas are for regular skilled workers.
What Companies Have to Do
Companies that sponsor foreign workers take on big responsibilities. They must pay all the government fees, which can cost thousands of dollars. They also must pay these workers the same amount they would pay Americans doing the same job.
The paperwork never ends. Companies must keep files on every foreign worker: their applications, wage records, and government forms. They must keep these papers for years, even after the person stops working there.
Companies also must tell the government if anything changes. If the worker gets a raise, moves to a different office, or quits, the company must report it. The government sometimes comes to check that companies are following all the rules.
Why Is This Important Now
America has way more jobs than people looking for work. Right now, there are about 2.8 million more job openings than unemployed people. Some states have it worse, for example, South Dakota only has 41 people looking for work for every 100 job openings.
Some industries struggle to find workers. Hospitals can’t find enough nurses, construction companies need about 500,000 more workers, and factories have over 300,000 empty jobs they can’t fill.
The problem will get worse as more baby boomers retire and fewer young people start working. This means foreign workers will become even more important for American businesses that want to grow and stay competitive.
